CVNR, J SA 1233/2017 JUDGMENT:

This second appeal is filed against the concurrent judgments of the Courts below whereby the suit filed by the appellant for cancellation of gift deed executed by him in favour of the respondent was dismissed and the appeal against the said judgment was also dismissed.

After arguing the case Mr. Mohd. Asifuddin, learned counsel for the appellant, submitted that during the pendency of the suit, i.e., on 17.3.2007 his client has executed a deed of cancellation of the gift and got it registered and that in view of the same, the second appeal need not be adjudicated on merits. In the light of the above submission, the second appeal is dismissed. However, this order shall not be understood as this Court upholding the validity of the deed of cancellation of the gift said to have been executed by the appellant.
