THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR CRIMINAL PETITION No. 11747 OF 2016 ORDER:
Heard the learned counsel for the petitioner and the learned Public Prosecutor.
2. The present Criminal Petition came to be filed under Sections 437 and 439 Cr.P.C. by the petitioner/A.3 seeking enlargement on bail in Crime No.12 of 2016 of Maredumilli Police Station, East Godavari District, registered for the offences punishable under Section 8 (c) read with 20 (b) (ii) (c) of the NDPS Act.
3. The case of the prosecution is that on 17.03.2016 at about 6.00 AM, police found the accused transporting 63 bags of ganja each weighing 2 Kgs and seized the same after complying with mandatory requirements. Basing on these allegations, the present crime came to be registered.
4. A perusal of the material on record would show that earlier vide order dated 11.07.2016 in Criminal Petition No.9517 of 2015, this Court dismissed the request made by the petitioner for grant of bail. No change, either on facts or on law, is noted, after the date of dismissal of the last bail application.
There being no change in the circumstances of the case, the request of the petitioner to
enlarge him on bail cannot be considered.
5. However, learned counsel for the petitioner submits that father of the petitioner died and hence his presence is required to perform certain customary ceremonies. If that being so, the petitioner is at liberty to approach the trial Court by way of making appropriate application along with material showing the same, in which event, the same shall be dealt with in accordance with law.
