HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.42920 OF 2018 ORDER:
The present writ petition came to be filed seeking to declare the action of the official respondents in not acting upon the complaint of the petitioner dated 8.11.2018 and also their inaction in preventing/removing/demolishing the illegal and unauthorised constructions made by the unofficial respondents in Plot No.336/A, M.L.A. Colony, Road No.12, Banjara Hills, Hyderabad and also by encroaching into the public road and footpath which is located in between the houses of the 2nd petitioner and unofficial respondents, as illegal and arbitrary.
When the matter is taken up for hearing, learned Standing Counsel for the respondents 2 to 4, would submit that earlier this Court by order dated 18.8.2015 in W.P.No.26056 of 2015, directed the respondents therein to dispose of the representation dated 10.5.2015 and pass appropriate orders as warranted under law within a period of six weeks from the date of receipt of copy of the order and communicate the same to the petitioner. It is stated that after the directions of this Court, the unofficial respondents 9 and 10 had assured all the neighbours that they will not encroach into the road and kept quiet for all these years, but recently the 11th respondent started encroaching on the public road and foot path and started making constructions. To bring the same to the notice of the official respondents, the petitioners submitted a representation requesting to remove the illegal constructions made by the 11th respondent and the same is pending consideration. Learned Standing Counsel for the respondents 2 to 4 would submit that if the representation of the petitioner is pending
consideration, the respondents 2 to 4 may be directed to deal with the same and pass appropriate orders, in accordance with law. Having regard to the above, the writ petition is disposed of directing the respondents 2 to 4 to deal with the representation dated 8.11.2018 submitted by the petitioners seeking to remove the illegal constructions made by the 11th respondent on the footpath of the subject premises and pass appropriate orders, in accordance with law, as early as possible preferably within a period of four to six weeks from the date of receipt of copy of this order after hearing the petitioner and all concerned. No order as to costs. Miscellaneous Petitions pending consideration, if any, in this Writ Petition shall stand closed.
