THE HON'BLE SRI JUSTICE M. SEETHARAMA MURTI Writ Petition No.36914 of 2017 ORDER:

This Writ Petition, under Article 226 of the Constitution of India, is filed seeking verbatim the following relief:

" For the reasons stated in the accompanying affidavit, it is prayed that this Honourable Court may be pleased to issue a Writ order or direction more particularly one in the nature of Writ of Mandamus, declaring the action of the respondents for marking and taking coercive steps for demolition of petitioners premises bearing D.No.3-13-81 belonging to the 1st petitioner, D.No.3-10105 to 3-10-113 belonging to 2nd petitioner, D.No.3-13-14 belonging to 3rd petitioner and Premises bearing D.No.3-13-17 & 3-13-18 belonging to the 4th petitioner, situated at Kotha Veedhi, main road, Mandasa village and Mandal, Srikakulam District without following the due process of law is being illegal, arbitrary, unconstitutional and against the provisions of the Right to Fair compensation and Transparency in Land Acquisition Rehabilitation and Resettlement Act, 2013 and pass such other order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case."

Heard the submissions of Sri S.M.Subhani, learned counsel appearing for the petitioners; learned Government Pleader for Revenue appearing for respondents 1 to 4; and of Sri Ch.Ravi, learned Standing Counsel, appearing for the 5th respondent. I have perused the material record.

At the hearing, learned Government Pleader would submit that only a proposal for laying the road was sanctioned and that the respondents would follow the procedure established by law before laying the road.

Recording the submissions, the Writ Petition is disposed of directing the respondents not to interfere with the possession of the petitioners over their respective properties in any manner except in strict accordance with the procedure established by law. There shall be no order as to costs.
