HON'BLE SRI JUSTICE C.PRAVEEN KUMAR CONTEMPT CASE No.1443 of 2016 ORDER:
Heard learned counsel for the petitioner.
The present Contempt Case is filed under Sections 10 to 12 of the Contempt of Courts Act stating that the respondents have violated the orders passed by this Court in W.P.No.23114 of 2016, dated 14.07.2016. A perusal of the order passed by this Court in W.P.No.23114 of 2016 would show that pursuant to a representation made by the learned counsel for the petitioner that the respondents have encroached on to the road and making illegal constructions, which was disputed by the learned counsel for the fourth respondent therein, this Court observed that any further constructions made will be subject to result of the writ petition. It is now stated that the respondents are proceeding further with constructions violating violated the order passed by this Court. Since the order passed by this Court was that the constructions made by the respondents shall be subject to the result of the writ petition, that by itself may not amount to contempt of court.
