HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.42942 of 2018 ORDER:

1) Heard learned counsel for the petitioners, Smt.M.Bhagyasri, learned Standing Counsel for respondent Nos.2 and 3, learned Government Pleader for Municipal Administration and Urban Development, appearing for respondent No.1 and learned Government Pleader for Roads and Buildings Department, appearing for respondent No.4. 2) The present Writ Petition came to be filed seeking issuance of writ of mandamus declaring the action of the respondents in widening the road from 60 feet to 80 feet towards Mamatha hospital to Gollagudem road in between Nethajinagar road Nos.3 and 4, in front of the petitioners' house plots, without acquiring the land of the petitioners' house plots in Survey No.87, vide plot Nos.17 and 45 of petitioner No.1 and plot Nos.18 and 19 of petitioner No.2, situated at Pakabanda, Khammam town, Khammam district, without following due process of law, as illegal and arbitrary.

3) Though various grounds are raised, learned counsel for the petitioners would submit that the authorities are trying to interfere with the property of the petitioners for the purpose of widening of the road from 60 feet to 80 feet, without following due process of law or initiating the proceedings under Land Acquisition Act.

4) Learned Standing Counsel would submit that any action to be taken by the authorities while interfering with the property of the petitioners shall only be in accordance with law. 5) Recording the said submission, the Writ Petition is disposed of directing the respondents not to interfere with the property of the petitioners, except in accordance with law. 6) There shall be no order as to costs.
