ORAL ORDER:

Heard learned counsel for petitioner, learned Government Pleader for Mines & Geology (AP) for respondents 1,3 and 4, learned Government Pleader for Revenue (AP) for respondents 2 and 5 and Sri V.Ravinder Rao, learned senior counsel appearing for proposed respondents.

The facts in brief are as under:

Petitioner filed an application on 17.8.2010 for grant of quarry lease for an extent of Ac.5.80 cents in Survey No. 198 and 199 of Atmakuru village, Mangalagiri mandal, Guntur district. Grievance of the petitioners is that said application is not approved and finalized in spite of direction issued by this Court as early as on 5.11.2012 in WP No. 5389 of 2011. On the contrary, respondent authorities are allowing illegal mining operations in the said survey numbers. Learned Government Pleader fairly submits that the competent authority will take a decision on the application submitted by the petitioner as expeditiously as possible. Learned counsel for petitioner agreed for disposal of the writ petition with the direction to the competent authority to consider the application submitted by the petitioner on 17.8.2010 and to pass orders for grant of quarry lease in accordance with law.

In view of the said submission, writ petition is disposed of directing the third respondent- Deputy Director of Mines and Geology, Guntur to dispose of the application submitted by the petitioner on 17.8.2010 for grant of quarry lease in survey numbers mentioned above as expeditiously as possible preferably within a period of six weeks. Till the orders are passed on the said application, respondents shall not allow any illegal mining operation in the said survey numbers. No costs.

Having regard to the same, miscellaneous, if any pending, are closed.
