THE HON'BLE SRI JUSTI CE SANJAY KUMAR AND THE HON'BLE MS. JUSTI CE J.UMA DEVI WRI T PETI TI ON NO.38540 of 2017 ORDER: (per SK,J) Challenge in this writ petition was to the proposed e-auction of the mortgaged property on 20.11.2017 pursuant to the e-auction proceedings dated 27.10.2017 issued by the Dena Bank, Eluru Branch. Learned counsel for the petitioner would state that pursuant to the interim order dated 16.11.2017, the amount of Rs.50,00,000/- has been deposited with the bank, albeit with some delay, but the sale proposed to be held on 20.11.2017 did not materialise for want of bidders. In that view of the matter, challenge to the e-auction proceedings dated 27.10.2017 is rendered purely academic and does not warrant consideration on merits.

On this short ground, the writ petition is dismissed leaving all issues open. Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
