THE HON'BLE SRI JUSTICE C.PRAVEEN KUMAR WRIT PETITION No. 19465 of 2016 ORDER :

The Writ Petition came to be filed seeking to issue a writ of mandamus declaring the action of respondent No.2 in demanding property tax pursuant to the Special Notice dated 01.10.2015 (received by petitioners on 28.12.2015) without considering the objections/revision filed against the same, as illegal and arbitrary.

2. Heard the learned counsel for the petitioners and Sri Md. Saleem, Standing Counsel for respondent No.2Municipality. At the request of both the counsel, the Writ Petition itself is taken up for disposal at the stage of admission.

3. The petitioners are said to have submitted separate revisions under Rule 12 of the Taxation and Finance Rules in Schedule II of the Andhra Pradesh Municipalities Act, 1965 to respondent No.2, which were received on 13.01.2016, Hence, it is for respondent No.2 to consider the same and take appropriate action thereon. Since the dispute is still pending consideration before respondent No.2, payment of the enhanced property tax cannot be insisted upon.

4. Accordingly, the Writ Petition is disposed of directing respondent No.2 to consider the revisions

submitted by the petitioners in accordance with law and pass appropriate orders thereon at the earliest. Further, pending the said revisions, the petitioners shall pay only the admitted property tax amounts and the authorities shall not take any coercive steps for collection of the disputed/enhanced property tax.

5. Pending miscellaneous petitions, if any, shall stand closed in the light of this final order. No order as to costs.
