PNR, J C.C. No.806 of 2016 ORDER:

By order dated 25.06.2015 made in WPMP No.15615 of 2015, the 4th respondent was directed not to undertake any further construction or development of the building until further orders. Alleging violation of the said orders and undertaking construction, this Contempt Case is filed.

In the affidavit filed by the respondent, he has admitted erection of the gate and also putting up of netted fence on the subject building. This Court, having regard to the order passed in the WPMP, prima facie found that even such construction was contrary to the directions issued. The learned counsel representing the respondent sought time for taking remedial steps. Accordingly, affidavit is filed enclosing the photographs of the building showing that the gate erected earlier and the net put on the building have been removed. In the affidavit also, the same is deposed. Having regard to the steps taken by the respondent, I am of the view that there is compliance of the directions issued by this Court. Taking the affidavit filed by the respondent on record, Contempt Case is closed. As the issue in this case is only with reference to the compliance of the directions issued by this Court, it is made clear that this Court did not enter the internal dispute between the parties on the title of the property or any other claims.
