THE HON'BLE DR. JUSTICE B.SIVA SANKARA RAO CIVIL REVISION PETITION Nos.6076 AND 6093 OF 2017 COMMON ORDER:

Heard learned counsel for the revision petitioner in both the matters, before ordering notice to the revision respondent and perused the grounds urged impugning the orders of the lower court in I.A.Nos.1163 and 1164 of 2017, pending C.M.A.No.77 of 2017 separately dated 27.10.2017 and particularly from dismissal of the I.A.No.1164 of 2017, the I.A.No.1163 of 2017 is dismissed and also perused the said impugned orders.

Once the very order of the lower appellate court in the pending C.M.A.No.77 of 2017 in I.A.No.1164 of 2017 particularly at Paragraph No.9 is clear that it is ready to dispose of the main C.M.A. itself from appearance of both sides on record, there is nothing to interfere with the said order, much less, by sitting in revision, but for to say, none of the observations in the impugned dismissal order will prejudice the learned appellate court in deciding the said C.M.A.No.77 of 2017 on own merits, with a further direction to hear and dispose of the said C.M.A. on own merits, within 15 days from the date of receipt of this order. 3.

Accordingly and with the above directions, these civil revision petitions are disposed of. Miscellaneous petitions pending consideration, if any, in these cases shall stand closed in consequence.
