THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.44644 of 2018 ORDER:

Heard learned counsel for the petitioner and learned Standing Counsel for Municipality. With their consent, the writ petition is disposed of at the admission stage. The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of respondent No.2 in issuing notice No.49/ A1/ 2018, dated 08.10.2018, in respect of vacant land tax No.1-5-15/ 3/ A, in Survey No.413/ A, admeasuring 371 square yards of Mothe Sivar village, Jagtial District, as illegal and arbitrary.

It is to be noted that it may not be necessary to issue notice to the unofficial respondents, since this Court is not going into merits of the case. Further, the explanation given by respondent No.4 to the said notice also indicates that he has sold the property to the writ petitioner.

Learned Standing Counsel for Municipality would contend that the petitioner may be directed to participate and submit his explanation to the said notice and thereafter the authorities concerned may deal with the same, in accordance with law. Having regard to the submission made, the writ petition is disposed of permitting the petitioner to submit his explanation to the notice dated 08.10.2018, within a period of two weeks from

the date of receipt of a copy of the order, in which event the authorities shall deal with the same, in accordance with law, after hearing all concerned. No order as to costs. Pending miscellaneous petitions shall stand closed in the light of this final order.
