THE HON'BLE SRI JUSTICE SURESH KUMAR KAIT WRIT PETITION No.24226 of 2016 ORDER:

Vide the present petition, the petitioner seeks a writ of mandamus declaring the action of respondents in laying a sewerage canal through his lands in Sy No.126/1 and 126/2 in an extent of Ac 0.38 cents situated at Fazulbegpeta of Srikakulam Municipal Corporation without acquiring land under the Rights To Fair Compensation And Transparency in Land Acquisition Rehabilitation and Resettlement Act 2013.

Learned counsel appearing on behalf of the respondents No.1 and 2 submits that the respondents have not laid any sewerage canal in the land of the petitioner, and if subsequently there is a plan to lay any such sewerage canal in the land of the petitioner, the procedure, as per law, shall be adopted. In view of the statement made by the learned counsel for the respondents No.1 and 2, the cause espoused in the petition is premature, and hence, there is no cause of action to be adjudicated.

Therefore, this Writ Petition is dismissed. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this revision petition shall stand dismissed.
