Heard Mr. K. Surender Reddy, learned Standing Counsel for the Warangal Municipal Corporation, for the respondent.

This Contempt Case is filed by the petitioner against the respondent herein alleging wilful disobedience of the order passed by a learned Single Judge of this Court in Writ Petition No.18931 of 2017, dated 11.07.2017. 3.

Vide above order, the learned Single Judge directed the petitioner to submit fresh representation to the respondent with regard to his grievance on or before 20.07.2017, and upon such submission of representation, the respondent shall consider the same, after affording reasonable opportunity to the 4th respondent therein, and pass appropriate orders as expeditiously as possible, in accordance with law, and communicate the same to the petitioner.

Learned counsel for the petitioner, in the Contempt Case, contended that the earlier suit instituted by the petitioner, viz., O.S.No.197 of 2014, for partition of the suit schedule property, on the file of the I Additional District Judge, Warangal, was subsequently disposed of by the Court below; and therefore, prayed this Court that petitioner may be permitted to avail the remedy available in law, as the cause in the present Contempt Case no longer survives for adjudication.

Therefore, in view of above submission, the Contempt Case is closed. However, it is kept open to the petitioner to revive the Contempt Case if there is any violation of the order passed by this Court. No costs.

Accordingly, the Contempt Case is closed. No costs. 7.
