HON'BLE THE CHIEF JUSTICE SRI THOTTATHIL B. RADHAKRISHNAN AND HON'BLE SRI JUSTICE S.V. BHATT WRIT PETITION No.42924 OF 2018 Order : (Per The Hon'ble The Chief Justice Sri Thottathil B. Radhakrishnan) The petitioner challenges what he calls the inaction of the 4th respondent in not considering the petitioner's objections as against Form-26 affidavit filed by the 5th respondent along with nomination papers.

2. This is a matter connected with the electoral process and is not therefore to be entertained by this Court at this point of time, however, leaving open all issues that may be available for consideration, after the declaration of results of the election. This principle in Article 329(b) of the Constitution of India dissuades us from entertaining this Writ Petition.

3. Hence, the Writ Petition is dismissed without prejudice.

4. As a sequel thereto, miscellaneous applications, if any, pending in the Writ Petition shall stand closed. _________________________________________ THOTTATHIL B. RADHAKRISHNAN, CJ ________________ S.V. BHATT, J 30th November, 2018.
