O R D E R

Aggrieved by the action of respondents in not considering the application of the petitioner dated 30.07.2018 for rectification of entries in the revenue records, in respect of the subject property, the present writ petition is filed.

Heard the learned counsel for the petitioner. Learned Assistant Government Pleader for Revenue produced written instructions of the 5th respondent - Tahsildar stating inter alia that the representation of the petitioner dated 30.07.2018 is under enquiry and necessary action will be taken within 30 days i.e., by 12.01.2019. It is further stated that the claim of the petitioner comes under civil litigation and he has to approach the competent civil court for adjudication in the matter.

Sri S.R.Sanku, learned counsel for the implead respondents, submitted that these respondents have interest in the subject property and hence before rectification of entries in revenue records in respect of subject property, 5th respondent may be directed to give opportunity to the implead respondents and take decision in accordance with law. Having regard to the facts and circumstances of the case, since the 5th respondent - Tahsildar, in the written instructions stated that the enquiry is in progress and that it will take about thirty days for taking necessary action, without expressing any opinion on merits, writ petition is disposed of directing the 5th respondent to dispose of the representation

of the petitioner dated 30.07.2018 by giving notice and opportunity of hearing to the petitioner, implead respondents herein and other affected parties, if any, and pass appropriate orders in accordance with law, within a period of two months from the date of receipt of a copy of this order. Interlocutory applications pending, if any, shall stand closed. No costs.
