SKK,J Crl.P_14670_2016 O R D E R:- This Criminal Petition is filed under Section 438 Cr.P.C. seeking to grant anticipatory bail to the petitioners-accused and direct the police concerned to release the petitioners on bail in the event of their arrest in respect of the complaint filed by Smt.Nyatri Lavanya @ Zoya Mubeen or her family members against them in Women Police Station, Kareem Nagar.
The learned counsel for the petitioners has submitted that the petitioners are apprehending arrest without fault on their part and the police may implicate them in a false case. The learned Additional Public Prosecutor has submitted that no case has yet been registered against the petitioners, as such, the present petition is not maintainable and the same may be dismissed.
Admittedly, no case has been registered against the petitioners so far, however, there was a call from Women Police Station, Kareem Nagar. Hence, this Court is inclined to dispose of the Criminal Petition by directing the Women Police Station Kareemnagar to give a notice to the petitioners 10 days in advance if the said police station comes to the conclusion that arrest of the petitioners is required in the case, if any, to be registered against them.
SKK,J Crl.P_14670_2016 With the above direction, the Criminal Petition is disposed of.
As a sequel, Miscellaneous Petitions, if any pending, shall stand disposed of as infructuous.
