THE HON'BLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.36817 of 2016 ORDER:
The writ petition is filed by the petitioners seeking a writ of certiorari quashing the F.I.R.No.168 of 2016 registered for the offences under Sections 3(1)(s) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act and Sections 323 and 506 IPC, on the file of the fourth respondent.
Heard and perused the material.
Learned counsel for the petitioners submits that the fourth respondent has registered the case being Crime No.168 of 2016 on the complaint lodged by the fifth respondent with all false allegations. He further submits that the first petitioner is a Headmaster and that the petitioners never committed any of the offences alleged against them. Hence, he prays this Court to quash the same.
Considering the facts and circumstances of the case, this Court is not inclined to quash the proceedings at the threshold. However, taking into consideration the fact that the first petitioner is a Headmaster and also the fact that there are land disputes between the petitioners and one Mr.Mukkala Ravinder Reddy, who is closely associated with the fifth respondent, the fourth respondent is directed to complete the investigation without arresting the petitioners and file final report, if any, in accordance with law. The writ petition is accordingly disposed of. Consequently, miscellaneous petitions, if any shall also stand disposed of. _____________________ JUSTICE RAJA ELANGO 31.10.2016 pln
