HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.8429 of 2002 ORDER:

This writ petition is filed by the petitioner under Article 226 of the Constitution of India seeking to direct the respondents to extend the heavy vehicle pay scale of 1986 viz., Rs.950-1670 and the corresponding revised pay scale of 1993 and to release all differential pay scale right from 12.10.1991 with all other monetary benefits.

The petitioner was selected as Driver in the A.P. Agricultural University and allotted to the office of Associate Director of Research, Agricultural Research Station of Nandyal. But he was posted as Driver at Anantapur, in the pay scale of Rs.810-1420(light vehicle scale). Subsequently, the services of the petitioner were utilized as bus driver w.e.f. 12.10.1991 as he was having heavy vehicle licence. He requested the authorities to extend the pay scale of heavy vehicle viz., 950-1670. But the respondents have not extended the said benefit. Hence, the petitioner filed this writ petition.

Heard and perused the material available on record. 4.
The main grievance of the petitioner is that the respondents may be directed to consider his services and extend the benefit of pay scale of heavy vehicles, since he has been driving the heavy vehicles. It is not in dispute that the petitioner possessed heavy vehicle licence and he has been driving the heavy vehicles. It is the further case of the petitioner that his juniors were allowed to draw revised pay scales of heavy vehicles. But his case has not been considered so far.

Considering the facts and circumstances of the case and the grievance of the petitioner, this Court is inclined to pass the following order:
"The respondents are directed to extend the benefit of heavy vehicle pay scale of 1986 viz., Rs.950-1670 and the corresponding revised pay scales and release all the differential pay scales right from 12.10.1991 with all other monetary benefits, as prayed by the petitioner in this writ petition." 6.
Accordingly, the Writ Petition is allowed. No costs. Consequently, miscellaneous petitions pending, if any, shall stand closed. ________________ RAJA ELANGO, J Date: 19th April, 2017 Nn
