HON'BLE SRI JUSTI CE A.V.SESHA SAI W .P.No.4 3 0 5 0 of 2 0 1 8 ORDER: - When the matter is taken up, the written instructions furnished by the Sub-Inspector of Police, Pahadisharif Police Station, Rachakonda Commissionerate, dated 29.11.2018, are placed on record by the learned Government Pleader. The said instructions read as under: - "On a complaint of U.Rama Jogi Raju/ 6th respondent herein lodged with the Police of Pahadishariff Police Station, Rachakonda Commissionerate, a case in Cr.No.425/ 2018 under Sections 147, 447, 504 r/ w 149 I.P.C., dated 26.11.2018, was registered against Mr.G.Amarnath Goud and others and investigation was taken up. The gist of the complaint is that the complainant/ 6th respondent herein and his brother and relatives are the absoslute owners of land, total admeasuring Ac.22.00 in Sy.No.

198, 199 situated at Jalpally village, Balapur Mandal, Ranga Reddy District, and the accused persons Mr.G.Amarnath Goud and others were criminally trespassed into the complainant's land and abused them and threatened them and stopped the work and the accused persons illegally sold Ac.2.00 of land in Sy.No.198 to Madhusudhan Goud, Arun Kumar Goud and Suryakala (writ petitioner herein) and that they are blackmailing the complainant and harassing him. The F.I.R. was registered on26.11.2018. The investigation is at the initial stage.

So far, the petitioner herein is not shown as accused in the F.I.R. The complainant stated in his complaint that the accused persons illegally sold Ac.2.00 of land in Sy.No.198 to Mr.Madhusudhan Goud, Arun Kumar Goud and Smt.Suryakala (petitioner herein) who are blackmailing and harassing the complainant/ 6th respondent herein. It is respectfully submitted that basing on the outcome of the investigation, appropriate action will be taken against the concerned accused in the F.I.R. It is pertinent to submit that to diver the attention of the investigating agency in not conducting the investigation in a fair and proper manner and to escape from her criminal overt acts in the above case (if any clues are forthcoming in the present case on hand), the petitioner filed the

present Writ Petition with false and frivolous allegations.

It is pertinent to submit that the petitioner is not all required in connection with the above case. If any information is received about the involvement of the petitioner and if any relevant documents are required for the purpose of investigation into the case, by following the due procedure, this respondent will take action against her.

It is pertinent to submit that this respondent never interfered with the subject land of the petitioner herein nor tried to dispossess her from the subject land as this respondent is not competent authority to do so. Having bore grudge against the complainant/ 6th respondent, the petitioner made false and baseless allegations against this respondent Police and hence the same are totally denied.

Copy of the F.I.R., is annexed to this written instructions for the kind perusal of this Hon'ble Court."

Accordingly, the Writ Petition is disposed of, by placing on record the said instructions furnished by the Sub-Inspector of Police, Pahadisharif Police Station, Rachakonda Commissionerate, dated 29.11.2018, with a further direction to the respondent-Police authorities not to interfere with the civil disputes unless the same is permissible in accordance with law.
