HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.10772 OF 2016 ORDER:- The Writ Petition is filed by the petitioners seeking a Writ of Mandamus to declare the action of the 4th respondent-District Panchayat Officer, Mahabubnagar in not taking steps against the 5th respondentSarpanch, Kodair Gram Panchayat, for the alleged allegations of misappropriation of funds of the 6th respondent - Gram panchayat and to declare the same as illegal, arbitrary and violative of Article 14 of the Constitution of India and also contrary to the provisions of the A.P. Panchayat Raj Act and Rules made there under. Heard both the learned counsel.

The grievance of the petitioner is that non-consideration of the representation made by the petitioners with respect to the misdeeds of the 5th respondent. It is the case of the petitioners that in the 6th respondentKodair Gram Panchayat committee, representing by the 5th respondentSarpanch, has misused the funds and the details of which have been set out in their letter dated 03.02.2016 addressed to the 4th respondent-District Panchayat Officer, Mahabubnagar. Hence, they only seek action on the 5th respondent.

Considering the limited prayer submitted by the petitioners, without expressing any opinion, this writ petition is disposed of directing the 4th respondent to consider the representation of the petitioners and take appropriate action in accordance with law. With the above direction the Writ Petition is disposed of. There shall be no order as to costs. Miscellaneous Petitions, if any, pending in this writ petition shall also stand closed.
