HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO Criminal Revision Case No.3293 of 2016 ORDER:

Impugning the order of interim maintenance of Rs.5,000/ - in Crl.M.P.No.77 of 2016 in FCMP No.42 of 2015 granted by the learned Judge, Family court, Kurnool, out of the claim sought for of Rs.20,000/ - p.m. besides legal expenses from the date of passing of the orders on 08.10.2016 against him on the application of his wife, the husband maintained the revision. In the course of revision, he filed a petition vide CrlRCMP No.414 of 2017 seeking to permit him to file additional material which shows that his wife-the respondent herein worked as a Vidya Volunteer in Masoomian Madrasa, Kallur Mandal for the period from 17.03.2015 to 23.04.2015 which is for the year 2014-15 and from 28.10.2015 to 23.04.2016 for the year 2015-16 temporarily on a contract basis on the honourarium of Rs.5000/ - p.m.

There is no further certificate to show still she is working or getting any remuneration. As it requires proof and the same not even filed before the lower Court covered by the impugned order particularly with observation at last page at para-6 of his(respondent) counter is silent with regard to the nature of his job but for saying she is working as Vidhya Volunteer and getting Rs.5,000/ - p.m. honorarium but he did not file any documents. Having regard to the above, as the main FCMP No.42 of 2015 is pending by upholding the interim maintenance however by modifying from Rs.5,000/ - to Rs.4,000/ -, the revision is disposed of with a direction to the learned Judge, Family Court to decide the main case within 4 months from the date of receipt of this order. No order as to costs.
