HON'BLE SRI JUSTICE V.RAMASUBRAMANIAN Civil Revision Petition No.6444 of 2017 Order:

Aggrieved by the dismissal of his application, seeking to send for the entire records available in different Court in execution proceeding, the plaintiff in a suit has come up with the above revision.

2. Heard Mr. K.V.L. Narasimha Rao, learned counsel for the petitioner.

3. As rightly observed by the Trial Court, it is up to the petitioner to obtain certified copies of the proceedings pending before the Principal Junior Civil Judge's Court, Nuzvid and produce them in evidence before the Senior Civil Judge's Court, Nuzvid, where the present proceedings are pending. The records in an execution petition pending in another Court, need not be summoned when there is an alternative remedy available. Hence, the civil revision petition is dismissed. The miscellaneous petitions, if any, pending in this revision shall stand closed. No costs.
