HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.38702 OF 2016 ORDER:

This writ petition under Article 226 of Constitution of India is filed seeking to declare the action of the respondents 1and 2, in not taking action on the representations of the petitioners, including the one, dated 10.09.2014, addressed to the 1st respondent, as illegal and arbitrary, and consequently, direct the respondents 1 and 2 to register FIR against the 3rd respondent.

Heard and perused the material available on record. The main grievance of the petitioners is that they made a representation to the Director General of Police, A.P., Hyderabad - 1st respondent herein, on 10.09.2014, against the 3rd respondent since there is a serious threat to them from the 3rd respondent. Considering the grievance of the petitioners, the respondents 1 and 2 are directed to register a case against the 3rd respondent, if the complaint lodged by the petitioners, dated 10.09.2016, discloses any cognizable offence and investigate into the same and file a final report, if any. If the petitioners are aggrieved by the action of the respondents 1 and 2, they are at liberty to approach the concerned Court, by invoking provision under Section 200 Cr.P.C.

Accordingly, the Writ Petition is disposed of. No order as to costs. Consequently, miscellaneous petitions pending, if any, shall stand closed.
