HON'BLE SRI JUSTICE V.RAMASUBRAMANIAN Second Appeal No.1245 of 2017 Judgment:

The second appeal is filed by the judgment-debtor, as against concurrent judgments and decrees passed in a suit for recovery of money.

2. Heard Mr. J.U.M.V. Prasad, learned counsel for the appellant.

3. The suit was for recovery of money on a promissory note. The defendant denied the execution of the promissory note. Therefore, when he was confronted as to whether he was prepared to have the promissory note sent for examination by hand-writing expert, he refused. In fact, the cheque issued by him bounced. The plaintiff examined not only herself as P.W.1 but also examined one of the attestors as P.W.2.

4. The findings by both Courts are concurrent. No substantial question of law arises in the second appeal. Hence, the second appeal is dismissed. The miscellaneous petitions, if any, pending in this second appeal shall stand closed. No costs.
