Heard Sri J.U.M.V.Prasad for petitioner and Mr.Shaik Mohammad for A.P. Wakf Board/respondent No.3.
One of the grievances of petitioner for invoking 226 jurisdiction is that respondent No.3 is proposing to construct a commercial complex in an extent of 36 cents covered by Kararnama dated 28.08.1991. Mr.Shaik Mohammad on instructions submits that a civil suit is pending before the Wakf Tribunal in O.S.No.72 of 2013. As on date, the Wakf Board does not have plans to change the utility or nature of the subject matter of writ petition.
On the question of title, Mr.Shaik Mohammad contends that the substantive issue is pending before the Tribunal.
At this stage of the matter, it shall not be understood that this Court expresses a view on the title or enjoyment. The order passed by this Court does not give scope for understanding in any other way except recording that the Wakf Board does not have intention to change the utility of land.
Writ petition is disposed of, with the above observations. No order as to costs.
Miscellaneous petitions, if any, pending, shall stand closed.
