THE HON'BLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.39348 OF 2016 ORDER:
The writ petition is filed by the petitioner seeking a writ of mandamus declaring the action of the respondents in not considering and disposing the representation, dated 09.08.2016, as illegal and arbitrary, and consequently to issue a direction to the respondents to consider and dispose of the representation. Heard and perused the material.
Learned counsel for the petitioner submits that though the petitioner made a representation on 09.08.2016, the official respondents are not considering and disposing of the representation of the petitioner and as such, he seeks a direction to the official respondents to dispose of the representation. He further submits that the petitioner has been implicated in the present crime being F.I.R.No.29 of 2016 and that the petitioner has not committed any offence. He further submits that the charge sheet is also filed before the Court below and as such, he prays this Court to stay all further proceedings in C.C.No.216 of 2016 on the file of the I Additional Judicial First Class Magistrate, Nizamabad.
Considering the facts and circumstances of the case, this Court is not inclined to stay all further proceedings in C.C.No.216 of 2016 on the file of the I Additional Judicial First Class Magistrate, Nizamabad. However, taking into consideration the fact that the representation of the petitioner, dated 09.08.2016, is pending before the official respondents, the official respondents are directed to consider and dispose of the representation of the petitioner.
