This writ petition, under Article 226 of the Constitution of India, is filed seeking to declare the in-action on the part of the 2nd respondent in deleting the lands in question of the petitioner from the prohibited list of properties in spite of making representation dated 02-02-2013 in that behalf, as being arbitrary and illegal and consequently to pass appropriate orders, in the interest of justice. 2.

Heard learned counsel for the petitioner and the learned Government Pleader for Revenue appearing for the respondents. 3.

It is stated by learned counsel for the petitioner that in respect of similarly placed lands in the same survey nos., the 2nd respondent has issued NOC, but the lands of the petitioner are not deleted though the instant lands is similar to the lands to which already NOC is granted.

In view of the facts and circumstances of the case, the writ petition is disposed of directing the 2nd respondent-District Collector, Vizianagaram District, to consider the representation dated 02-02-2013 made by the petitioner in that behalf and pass appropriate orders thereon, in accordance with law, within a period of four months from the date of receipt of a copy of this order. Since it is stated by learned counsel that to similar lands situated in the same survey number, NOC is granted, it is open for the petitioner to submit additional material papers in support of his claim and the 2nd respondent to take note of the same while disposing of the case of the petitioner. Miscellaneous petitions, if

any, pending in this writ petition shall stand closed. There shall be no order as to costs.
