THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.5135 of 2016 ORDER:

The grievance of the petitioner is with regard to the maintenance of a rowdy sheet in his name on the file of Velairpad Police Station, West Godavari District. According to the petitioner, he has been acquitted in all the criminal cases registered against him in the years 2009 and 2010. Despite the same, the rowdy sheet is being continued.

The Sub Divisional Police Officer, Jangareddigudem, filed a counter-affidavit stating that the petitioner was involved in four cases in the years 2009 and 2010. He however admitted that three cases were compromised and the fourth one ended in acquittal of the petitioner. The rowdy sheet was stated to have been opened in his name in the year 2010 and is presently extended up to the end of the year 2016. The Sub Divisional Police Officer further stated that in the event the petitioner made an application, the competent authority would review the necessity of continuing with the rowdy sheet in his name and would take steps in accordance with law.

In that view of the matter, the writ petition is disposed of permitting the petitioner to make a fresh representation to the Sub Divisional Police Officer, Jangareddigudem, seeking closure of the rowdy sheet opened in his name and being maintained on the file of Velairpad Police Station, West Godavari District. In the event such a representation is made, the authority concerned shall consider the same under the relevant standing orders and in the light of the law laid down by this Court in K.Suresh Babu v. Superintendent of Police, Anantapur District[1].

This exercise shall be completed expeditiously and in any event, not later than four (4) weeks from the date of receipt of the petitioner's representation. Pending miscellaneous petitions, if any, shall stand closed in the light of this final order. No order as to costs.
