HON'BLE Dr. JUSTICE B. SIVA SANKARA RAO CRIMINAL PETITION Nos.17327 & 17328 of 2016 COMMON ORDER :
Heard learned counsel for the petitioner and also the learned Public Prosecutor representing the State in both the matters and perused the material.

The respective petitioners are the so-called share purchasers stating those were freezed and it applied for defreezing and the applications i.e., Crl.M.P.No.572 and 573 of 2016 are not disposing of by the learned XIII Metropolitan Magistrate, Nacharam, Hyderabad from the non co-operation by the Assistant Public Prosecutor saying that in one case, the investigation is forwarded to C.B.C.I.D. and the other case, instructions to be taken and that the Court in one of the cases returned the applications as to record not received. 3.
Having regard to the above, the criminal petitions are disposed of by directing the lower Court, if at all, there is any record relating to Crime No.248 of 2013 originally filed before it, returned by it endorse specifically to that effect, and if at all, the investigation is taken up from regular police by C.B.C.I.D., direct the learned Assistant Public Prosecutor to file memo in writing to that effect and represent by taking instructions from the so-called investigating agency on either way and dispose of the above applications on own merits, preferably within three months from the date of receipt of copy of the order.

Miscellaneous petitions pending, if any, in the criminal petition shall stand closed.
