HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.43261 OF 2018 ORDER:

Heard learned counsel for the petitioners, learned Government Pleader for Municipal Corporation and Urban Development and learned Standing Counsel for GHMC.

Since this Court is not going into merits of the case, it may not be necessary to issue notice to the unofficial respondent. 3.

The present writ petition came to be filed seeking issuance of writ of Mandamus declaring the inaction of respondent No.2 in considering the representation dated 09.10.2018 of the petitioner for taking appropriate legal action against the illegal construction by the 4th respondent over the Masjid property, as illegal and unconstitutional.

Learned counsel for the petitioner submitted that though the petitioner submitted representation on 09.10.2018 seeking to take appropriate action against the illegal construction made by the 4th respondent on the Masjid property, no action has been taken, so far. 5.

Learned standing counsel for the 2nd respondent would submit that a direction may be given to the 2nd respondent to pass appropriate orders on the representation made by the petitioner in accordance with law.

Having regard to the above, the Writ Petition is disposed of directing respondent No.2 to deal with the representation dated 09.10.2018, made by the petitioner, seeking to take appropriate action against the illegal construction made by the 4th respondent on

the Masjid property in accordance with law, after hearing the petitioner and all concerned, as early as possible. No costs. 6.

Miscellaneous petitions, pending if any, shall stand closed in the light of this final order.
