THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.9632 of 2016 ORDER:
Heard Ms. V. Manjula, learned counsel for the petitioner, and Ms. Pingali Lakshmi, learned Standing Counsel for the Greater Warangal Municipal Corporation.
The prayer of the petitioner in this case is as under: "For the reasons stated accompanying affidavit, it is therefore prayed that this Honourable Court may be pleased to call for the records from the respondents herein and issue writ order or direction particularly one in the nature of writ of Mandamus by declaring the inaction of respondent herein in not considering representation dated 01.03.2016 is arbitrary, illegal, unjustified, in violation principles of natural justice and also in violation of Article 14 and 21 of Constitution of India consequently direct the respondent to consider petitioner's representation dated 01.03.2016 and to pass such other order or orders as this Honourable Court may deem think fit and proper in the circumstances of case and in the interest of justice." As the petitioner's representation dated 01.03.
2016 seeking permission to construct a compound wall is still pending consideration before the Corporation, this Court does not deem it proper to entertain this writ petition for adjudication on merits at this stage. The writ petition is accordingly disposed of directing the Greater Warangal Municipal Corporation to consider the representation dated 01.03.2016 made by the petitioner in accordance with the rules. In the event the petitioner's request for permission is rejected, the reasons therefor shall be recorded and communicated to her. This exercise shall be completed expeditiously and in any event, not later than three weeks from the date of receipt of a copy of this order. Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
