HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITON No.39529 OF 2017 ORDER:
This writ petition is filed challenging the impugned provisional assessment notice dated 24-08-2017, alleging theft of energy and wherein the petitioner was directed to pay 50% of the provisionally assessed amount of Rs.1,09,760.50, supervision charges and reconnection charges.
Learned counsel for the petitioner says that the respondents have not properly assessed the amount and the petitioner will be able to substantiate his claim in the enquiry under Section 154 of the Electricity Act, 2003 (for short "the Act6"). Heard Sri R.Vinod Reddy, learned Standing Counsel for the respondents.
Since final determination is pending, the writ petition is disposed of directing the respondents to restore power supply on payment of 50% of the demanded amount out of Rs.1,09,760.50 ps i.e. Rs.55,000/- (Rupees Fifty five thousand only) and the payment will be subject to further determination under Section 154 of the Act. However, this order will not preclude the Special Court from determining civil liability under Section 154 of the Act.
With the above direction, the writ petition is disposed of. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed.
