HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.40857 of 2016 ORDER:

This writ petition is filed by the petitioner under Article 226 of the Constitution of India seeking to direct the 3rd respondent to take necessary action on his complaint dated 24.10.2016.

Heard and perused the material available on record. 3.

It is stated in the affidavit that while the petitioner was plugging his lands with a tractor, about 16 persons, who are related to him, trespassed into his land, stopped the tractor, caused obstructions to the cultivation and beat him with hands and sticks. He made a complaint to the 3rd respondent. But he did not take any action. Again on 8.6.2016 while the petitioner was in his lands, the same persons trespassed into his lands, shouted at him and beat him. It is alleged that the same persons are coming frequently to the lands of the petitioner and beating him. Therefore, he lodged a complaint again on 24.10.2016 to the 3rd respondent. But no action has been taken so far. 4.

Considering the facts and circumstances of the case and the grievance of the petitioner, without expressing any opinion on merits, the 3rd respondent is directed to register a case on the basis of the complaint made by the petitioner on 24.10.2016, if it discloses any cognizable offence. If the 3rd respondent fails to do so, the petitioner is at liberty to avail the remedies that are available under the Code of Criminal Procedure. 5.

Accordingly, the Writ Petition is disposed of. No costs. Consequently, miscellaneous petitions pending, if any, shall stand closed. ________________ RAJA ELANGO, J Date: 24th November, 2016 Nn
