THE HON'BLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.37055 of 2016 ORDER:

The writ petition is filed by the petitioners seeking a writ of mandamus declaring the action of the respondents 2 and 3 in harassing the petitioners in crime No.403 of 2016 on the file of the third respondent as illegal and arbitrary, and consequently to quash the same against the petitioners. Heard and perused the material.

Learned counsel for the petitioners submits that the first petitioner is falsely implicated in the present crime though there are no specific allegations against the first petitioner and that the third respondent is trying to implicate the second petitioner in the crime at the instigation of the fourth respondent and that the third respondent is harassing the petitioners in the name of investigation. Hence, he prays this Court to quash the case against the petitioners herein.

Considering the facts and circumstances of the case, the respondents 2 and 3 are directed to complete the investigation without arresting the first petitioner and file final report, if any, in accordance with law. It is made clear that without there being any case registered against the second petitioner, the respondents 2 and 3 are directed not to interfere in personal affairs of the second petitioner and further if any case is registered against the second petitioner, the respondents 2 and 3 are directed to complete the investigation without arresting the second petitioner and file final report in accordance with law.

The writ petition is accordingly disposed of. Consequently, miscellaneous petitions, if any shall also stand disposed of. _____________________ JUSTICE RAJA ELANGO 01.11.2016 pln
