THE HON'BLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.36998 of 2016 ORDER:
The writ petition is filed by the petitioner seeking a writ of mandamus declaring the highhanded action of the respondents 3 and 4 in threatening the petitioner to appear before their police station for settlement of the issue in connection with F.I.R.No.124 of 2016 though he is not an accused, as illegal and arbitrary and consequently to direct the respondents 3 and 4 not to call for the petitioner to the police station. Heard and perused the material.
Learned counsel for the petitioner submits that the respondents 3 and 4 are interfering with the personal affairs of the petitioner and that they are calling the petitioner to the police station and harassing the petitioner for settlement of the issue in connection with F.I.R.No.124 of 2016 though he is not an accused in the said crime.
Considering the facts and circumstances of the case, the respondents 3 and 4 are directed not to interfere with the personal affairs of the petitioner and to follow the procedure established in Code of Criminal Procedure. If any case is registered against the petitioner in relation to F.I.R.No.124 of 2016, the respondents 3 and 4 are directed to complete the investigation without arresting the petitioner and file final report, if any, in accordance with law.
