THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.39378 OF 2017 ORDER:
Heard learned counsel for the petitioner and learned standing counsel for the respondents.
The petitioner applied for the post of Driver and he was selected on 12.11.2009. He was directed to report to duty on 20.11.2009 along with original driving licence, educational certificates, caste certificate, employment card and two passport size photos for directing him to medical examination. Accordingly, the petitioner submitted all the required documents. He had undergone necessary training at Zonal Staff Training College, Warangal, and reported to the Office of the second respondent for driving test after completion of training. He underwent driving test on 13.09.2009 and the result of the same was not informed to the petitioner. He was again sent for training for a period of five days and he was sent for driving test on 05.02.2010, 07.05.2010, 21.06.2010 and 06.12.2010.
Again the result of the said driving tests was not communicated to the petitioner till August, 2017. He submitted a representation to the second respondent on 15.07.2017 and he was surprised to receive a copy of the proceedings dated 22.08.2017 informing that he was not found suitable to the post of Driver consequent to his failure in driving tests. Now seven years have elapsed and the petitioner alleges that the impugned proceedings are issued only to deny employment to him.
In the circumstances, the petitioner was directed to produce the copy of the driving licence and he produced the driving licence and it is valid upto 03.02.2018. Since there is a dispute with regard to the driving skill of the petitioner, the second respondent is directed to send the petitioner for driving test as a last opportunity on a particular date in the presence of the Officer of the Telangana State Transport Department and
on the basis of the result of such driving test, appropriate orders shall be passed by the second respondent. In the circumstances, the impugned order dated 22.08.2017 is set aside.
The writ petition is accordingly disposed of. Consequently, miscellaneous petitions pending, if any, shall stand closed. There shall be no order as to costs.
