P. Jayamma v. S. Vimala
THE HON'BLE SRI JUSTI CE SANJAY KUMAR CI VI L REVI SI ON PETI TI ON NO.7252 OF 2018
O R D E R
This civil revision petition is sought to be maintained against the Docket Order said to have been passed by the learned Principal District Judge, Ranga Reddy District, on 16.11.2018 in an I.A. filed by the petitioner to furnish certified copies of the judgment and decree in A.S.No.147 of 2012 on the file of the learned XII Additional District Judge, Ranga Reddy District at Vikarabad. The order under revision reads as follows:
'16-11-18 The record is seized for perusal by the Hon'ble HC, hence, certified copy of the judgment cannot be issued. Hence returned. Sd/- 16/11/18'
In the light of the aforestated order, Sri C.Hanumantha Rao, learned counsel for the petitioner, was asked as to whether it is not a fact that the record has been seized by this Court. The learned counsel is not in a position to say that it is not so. That being so, this Court is at a loss to understand as to how the petitioner can find fault with the District Court in not issuing the certified copies of the judgment and decree which are not even in its possession. The civil revision petition is therefore devoid of merit and is accordingly dismissed. Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
Dismissal of this civil revision petition shall not preclude the petitioner from working out her remedies in accordance with law to obtain the certified copies of the judgment and decree in question. _______________ SANJAY KUMAR, J 15th DECEMBER, 2018 Svv
