HON'BLE SRI JUSTI CE A. RAMALI NGESWARA RAO Writ Petition No.38400 of 2017 Order:

This Writ Petition is filed by the Driver who is involved in the departmental proceedings. He filed the present Writ Petition when a show cause notice was issued for removal from service on 06.11.2017 by the third respondent. In the said show cause notice, the petitioner was asked to submit his explanation within seven (7) days from the date of issue of the notice i.e., 06.11.2017. Since it is only a show cause notice, this Court is not inclined to entertain the present Writ Petition, but since the said period of one week had already expired, the petitioner is given another one week time from today to submit his explanation to the show cause notice and the third respondent shall pass appropriate orders in accordance with law only after considering the explanation submitted by the petitioner to the show cause notice. If the petitioner does not submit the explanation within the time granted, it is open to the third respondent to take appropriate action.

The Writ Petition is, accordingly, disposed of. There shall be no order as to costs.

As a sequel thereto, the miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
