The grievance of the petitioner in the present Civil Revision Petition is non-disposal of O.S.No.367 of 2004 on the file of Junior Civil Judge, Dhone, Kurnool district.

The respondent herein instituted the said suit for permanent injunction. It is submitted by the defendant/petitioner herein that along with the suit, the respondent/plaintiff also filed I.A.No.857 of 2004 for temporary injunction under Order 39 Rules 1 and 2 of CPC, but the same ended in dismissal on 28.10.2004. It is further submitted by the learned counsel that because of the pendency of the said suit, the defendant/petitioner herein is sustaining irreparable loss and hardship and also mental agony.

Having heard the learned counsel for the petitioner and taking into consideration the facts and circumstances of the case, the Revision is disposed of, directing the Court of Junior Civil Judge, Dhone, Kurnool district to dispose of O.S.No.367 of 2004 as expeditiously as possible. As a sequel, the miscellaneous petitions, if any, shall stand closed. There shall be no order as to costs.
