HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 4330 of 2016 ORDER:
Heard learned counsel for the petitioner, Government Pleader for Home and Sri Y.Ravindra, learned counsel for respondent Nos.3 and 4. With the consent of all the parties, the writ petition is taken up for disposal at the admission stage. The present writ petition came to be filed seeking issuance of writ of mandamus declaring the inaction of the second respondent in investigating and filing the final report in Crime No.60 of 2015 of Charminar Police Station, registered for an offence punishable under Section 3 (1) (ix) of the Scheduled Caste and Scheduled Tribes (Prevention of Atrocities) Act, as illegal and arbitrary.
When the matter is taken up for hearing, the Government Pleader for Home placed on record the instructions received from the concerned, wherein it is stated that the investigation is completed and the Assistant Commissioner of Police has orally informed that they are going to file final report after obtaining legal opinion from the Public Prosecutor.
Having regard to the facts and circumstances of the case, the writ petition is disposed of directing the respondent-police to file a final report as stated by the Government Pleader for Home, within a period of four (04) weeks from the date of receipt of a copy of the order, in which event the petitioner shall avail the remedies available under law. There shall be no order as to costs.
Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
