THE HON'BLE DR.JUSTICE SHAMEEM AKTHER CRIMINAL PETITION No.12805 OF 2018 ORDER:

This Criminal Petition, under Section 439 of the Code of Criminal Procedure, 1973, is filed by the petitioner/accused No.2 for grant of bail in Crime No.38 of 2018 of Amalapuram Taluk Police Station, East Godavari District, registered for the offence punishable under Section 397 IPC.

Heard the learned counsel for the petitioner/accused No.2, the learned Additional Public Prosecutor representing the respondent-State and perused the record.

It is also stated that many of the accused in the subject crime are in judicial custody. The allegations are specific and grave. The punishment for the said offence is also stringent. As per the record, the petitioner/accused No.2 is a habitual offender. If he is

released on bail, he would indulge in commission of similar offences. There is every possibility of influencing the witnesses and absconding. Therefore, it is not a fit case to allow the application. 5.

Accordingly, the Criminal Petition is dismissed. Miscellaneous petitions pending, if any, in this Criminal Petition shall stand closed.
