THE HON'BLE SRI JUSTI CE C.PRAVEEN KUMAR W RI T PETI TI ON No. 3 8 9 6 9 of 2 0 1 6 ORDER:

Heard learned counsel for the petitioners and learned Government Pleader for Revenue.

2.

With the consent of both the parties, the Writ Petition is disposed of at the admission stage.

3.

The present Writ Petition came to be filed with the following prayer:

'For the reasons stated in the accompanying affidavit, it is hereby prayed that this Hon'ble Court may be pleased to issue a Writ or order or direction more particularly one in the nature of writ of Mandamus declaring the action of the fourth respondent in not recording names of the petitioners as pattadars in record of rights and in not issuing pattadar pass book and title deeds in respect of the land admeasuring Acs.4.90 cents situated in R.S.No.118/ 1 of Madhuravada Village, Visakhapatnam Rural Mandal, Visakhapatnam District, inspite of application dated 11.07.2014 as illegal and arbitrary'.

4.

Though various grounds are raised, learned counsel for the petitioners restricts his prayer seeking a direction to the fourth respondent to consider the application dated 11.07.2014. 5.

Learned Government Pleader for Revenue submits that the request of the petitioner could not be considered since the

application is made in the year 2014, but, however, since the procedure has been changed now, he submits that the petitioners may be directed to make an application through online, in which event, the same shall be dealt with, in accordance with law. 6.

Recording the said statement, the writ petition is disposed of directing the petitioners to make a fresh application in accordance with the prescribed procedure, in which event, the Tahsildar shall hear the petitioners and the concerned before passing any orders in respect of mutating the names of the petitioners in land admeasuring Acs.4.90 cents in Survey No. R.S.No.118/ 1 of Madhuravada Village, Visakhapatnam Rural Mandal, Visakhapatnam District.

7.

Miscellaneous petitions, pending if any, shall stand closed in the light of this final order. No order as to costs. _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ JUSTI CE C.PRAVEEN KUMAR 11.11.2016, vhb
