O R D E R

Aggrieved by the inaction of 5th respondent - Tahsildar, in considering the representations of the petitioners', the latest one being dated 03.11.2018, for conducting survey of the subject land and to mutate their names in the revenue records, as per the family member certificate, the present writ petition is filed. Heard the learned counsel for the petitioners. Learned Assistant Government Pleader for Revenue, on instructions, stated that petitioners have not made application through online / F-line as per the circulars of the Government in vogue by paying the requisite fee. He also produced detailed written instructions of the 3rd respondent - Tahsildar in Rc.No.533/ 2018/ A dated 27.11.

2018, the tenor of which is that, the subject land is endowment land belonging to SVLN Devasthanam and hence, the request of the petitioners cannot be considered. Learned counsel for the petitioners, disputed the written instructions and submitted that the petitioners are having necessary documents in support of their claim and the application of the petitioners may be directed to be considered and take action in accordance with law. It is to be seen that the petitioners, as per the instructions of the learned Assistant Government Pleader for Revenue, have not filed application through Online / F-line by paying the requisite fee and hence written instructions of the 3rd respondent, cannot be considered at this stage.

petition is disposed of, giving liberty to the petitioners to make necessary application through On-line / F-line by paying the requisite fee along with necessary documents in support of their claim, and the 5th respondent is directed to dispose of the same in according with law after issuing notice and opportunity of hearing to the petitioners and other affected parties, if any, and also taking into consideration the averments made in the above written instructions dated 27.11.2018, and pass appropriate orders within a period of six weeks from the date of receipt of such application, and communicate the same to the petitioners.

Interlocutory applications pending, if any, shall stand closed. No costs.
