THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM CONTEMPT CASE No. 2405 OF 2017 O R D E R :
The Contempt Case is filed alleging disobedience of the order dated 31.07.2017 in Writ Petition No. 25208 of 2017, which directed the respondent - Superintendent of Police, being the District Head of the Organization to conduct a preliminary enquiry and if the allegations made by the petitioner are found to be true, necessary action should be taken in accordance with law and the petitioner should be intimated the action taken within a period of four weeks from the date of receipt of a copy of that order. Pursuant to the notice issued in this Contempt Case, counter-affidavit and reply affidavit is filed. On 21.06.2018, this Court observed that prima facie, there was violation on the part of the respondent in conducting preliminary enquiry. The learned counsel for the respondent therefore, sought time to report compliance.
Today, learned counsel for the respondent has placed before this Court the letter addressed by the Superintendent of Police, West Godavari at Eluru, dated 08.07.2018 to the effect that pursuant to the directions issued by this Court in the Writ Petition, the Station House Officer conducted investigation into the allegations of the petitioner, but however, the same was not informed to the latter, hence, a charge memo was issued to the Station House Officer concerned vide C.No. 195/PR-A9/2018, dated 06.07.2018.
In view of the same, since the order complained of in this Contempt Case is obeyed by conducting preliminary enquiry into the allegations of the petitioner, though belatedly, I do not consider
that to be a serious lapse to continue the contempt proceedings any further.
Accordingly, the Contempt Case is closed.
