HONOURABLE SRI JUSTICE M.S.K. JAISWAL CRIMINAL PETITION No. 12473 of 2016 ORDER:
The criminal petition is filed under Section 482 Cr.P.C. seeking to quash the proceedings in Crime No. 127 of 2013 on the file of the Station House Officer, Shankarpally Poice Station, Ranga Reddy District, which has later been handed over to CID, Hyderabad.
Heard the learned counsel appearing for the petitioner/Accused No.1, and the learned Additional Public Prosecutor, representing the State.
Having heard the learned Counsel on either side and gone through the material available on record, it is obvious that specific allegations were made in the complaint against the petitioner/Accused 2. This is a matter which requires investigation by the police. The truth or otherwise of the allegations can only be decided during course of investigation or trial. I see no ground to interdict the investigation at this stage and quash the first information report.
However, it is submitted by the learned Counsel for the petitioner that the CID authorities have not filed charge sheet/final report till date.
On the other hand, learned Public Prosecutor representing the State submits that the investigation in the aforesaid crime is completed and charge sheet is made ready and the same will be filed shortly.
Having heard the learned Counsel on either side and gone through the material available on record, the Criminal Petition is disposed of directing the CID, Hyderabad to file charge sheet in
the aforesaid Calendar Case within one month from today Miscellaneous petitions pending consideration if any in the Criminal Petition shall stand closed in consequence. No order as to costs.
