HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITON No.37559 of 2017 ORDER:
The petitioner is challenging the impugned proceedings dated 11-04-2017, wherein the petitioner was directed to pay the amounts regarding back billing.
Learned counsel for the petitioner says that without issuing notice, the impugned proceedings were issued. On the other hand, Sri R.Vinod Reddy, learned Standing Counsel for the respondent-Corporation submits that the petitioner should have made representation to the respondentauthorities, since the impugned proceedings provide a clause for making representation.
In view of the same, this Court is not inclined to interfere with the impugned proceedings. But however, in view of the facts and circumstances of the case, it is open for the petitioner to make a representation to the respondent-authorities within a period of four weeks from today. Since learned counsel for the petitioner says that assessment is not proper, meanwhile the respondents shall restore power supply to the petitioner's service connection on payment of 1/3rd of the demanded amount and which will be subject to further orders passed by the respondents after submitting representation by the petitioner. If the petitioner fails to file any representation within the aforesaid period, it is for the respondents to take action in accordance with law.
Accordingly, the writ petition is disposed of. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed.
