HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.43150 of 2018 ORDER:
The case of the petitioner is that petitioner-society was issued notice dated 17-11-2018 in Form-II under Rule 3 of the Andhra Pradesh Assignment Lands (Prohibition of Transfer) Rules, 2007 and the petitioner-society filed explanation on 26-11-2018. But no orders are passed. Without passing any orders, the respondents are trying to interfere with the possession of the petitioner-society from the land in an extent of Ac.1-85 cents in Sy.No.39/2 of Mulakuddu Village, Bheemunipatnam Mandal, Visakhapatnam District consisting of buildings in which three institutions are being run. Aggrieved by the same, the present writ petition is filed. Heard learned counsel for the petitioner-society. Learned Assistant Government Pleader for Revenue on instructions submits that on the representation of third parties, the impugned notice is issued and as on today, the respondents are not interfering with the subject property. Until final orders are passed, they will not take any action.
Accordingly, the writ petition is disposed of directing the competent authority to pass appropriate final orders, since the petitioner has already submitted explanation. Till passing of final orders, the respondents shall not dispossess the petitioner from the subject property.
There shall be no order as to costs. Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
