HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.36525 OF 2016 ORDER:

The present writ petition is filed by the petitioner seeking to declare the action of the respondents in opening and continuing the Rowdy Sheet, dated 26.09.2016, on the file of the Alipiri Police Station, Alipiri, Tirupathi, by the 4th respondent, as illegal and arbitrary, and consequently, direct the respondents to close and to quash the Rowdy Sheet opened against him.

Heard and perused the material available on record. Upon hearing the arguments of both sides, and on perusing the material available on record, this Court is not inclined to grant the relief sought for by the petitioner.

When this Court expressed its opinion that this Court is not inclined to set aside the Rowdy Sheet, opened against him, learned counsel for the petitioner confined his prayer and requested to direct the police not to harass the petitioner under the guise of pendency of Rowdy Sheet against him and whenever they want to take action against the petitioner, they should follow the procedure in accordance with law. In view of the submissions of the learned counsel for the petitioner, this Court is inclined to pass the following order: The respondents are directed not to harass the petitioner under the guise of pendency of the Rowdy Sheet against him and at the same time, if the respondents want to investigate any crime registered against the petitioner, they shall follow the due process of law.

With the above directions, the Writ Petition is disposed of. No costs. Consequently, miscellaneous petitions pending, if any, shall stand closed.
