THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.35819 of 2016 ORDER:

This Writ Petition, under Article 226 of the Constitution of India, is filed seeking to declare the inaction of the 5th respondent in acting on the proceedings in Rc.No.A2/2823/2016, dated 06.05.2016, issued by the 4th respondent for taking action on the 6th respondent for misappropriating an amount of Rs.1,16,000/- which was collected by her at the time of auction of the fishing rights in the lake located at Pamidivaripalem Village, Pedanandipadu Mandal, Guntur District, belongs to the Endowments Department, as arbitrary and illegal and consequently, to direct the 5th respondent to implement the aforesaid proceedings, dated 06.05.2016.

In the affidavit filed in support of the petition, it is stated that the petitioner is a social activist and used to participate in the development activities of Pamidivaripalem Village. While so, the 5th respondent has auctioned the fishing rights in the lake at Pamidivaripalem Village. The 6th respondent, who is Sarpanch of said village, has collected an amount of Rs.1,16,000/- from the successful bidder and has not deposited the amount with the 5th respondent department. Having come to know the said aspect, the petitioner submitted a representation on 22.04.2016 to respondents 2 to 4. Having considered the said representation, respondent No.4 has issued proceedings directing the 5th respondent to enquire on the complaint submitted the petitioner and take appropriate action. The 5th respondent, who obliged to act on the proceedings, dated 06.05.2016, has not taken any

action so far for the reasons best known to him. Hence, the Writ Petition.

This Court perused the material on record and heard the arguments.

Learned counsel for the petitioner submits that though the 4th respondent has issued proceedings directing the 5th respondent to enquire into the complaint made by the petitioner, till date no action has been taken.

Considering the facts and circumstances of the case, the Writ Petition is disposed of directing the 5th respondent to take action on the complaint, dated 22.04.2016, submitted by the petitioner pursuant to the proceedings, dated 06.05.2016, of the 4th respondent, as expeditiously as possible, preferably within a period of two (02) months from the date of receipt of a copy of this order. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed. __________________ RAJA ELANGO, J OCTOBER 24, 2016 YVL
